Terms of Service

1. About these Terms

These Terms govern providers’ use of the Forteel platform. Certain sections also apply to clients who use Forteel-powered booking pages, including provisions concerning platform use, bookings, payments and cancellations. The contract for the underlying appointment or professional service is between the provider and the client.

2. Who operates Forteel

Forteel is operated by DUTYCREST LTD (company number 17001692), registered in England and Wales, registered office 128 City Road, London EC1V 2NX (“Forteel”, “we”, “us”, “our”).

3. Definitions

  • “Forteel” means the booking-protection platform operated by DUTYCREST LTD.
  • “Provider” means a person or business using Forteel to manage bookings for their own services.
  • “Client” means a person booking an appointment through a Forteel-powered booking page.
  • “Booking” means an appointment created through the Platform.
  • “Booking Payment” means the deposit or full payment collected in connection with a Booking.
  • “Cancellation Policy” means the cancellation terms a Provider configures and displays to Clients.
  • “Platform” means the Forteel website, dashboard, booking pages and related services.
  • “Subscription”means a Provider’s paid access to the Platform.
  • “Stripe”means Stripe, Inc. and its affiliates, Forteel’s third-party payment processor.

4. Who may use Forteel

To use Forteel as a Provider, you must:

  • be at least 18 years old;
  • have authority to enter into this agreement, whether personally or on behalf of a business;
  • operate a genuine business or professional service;
  • hold any licences, registrations, insurance or permissions required for your activity;
  • ensure your services and booking terms comply with applicable law;
  • keep your account and payment information accurate.

Providers use Forteel wholly or mainly for their trade, business, craft or profession.

5. Forteel’s role

Forteel provides the technology used to create bookings, collect Booking Payments through Stripe, record Cancellation Policies and apply platform workflows. Forteel does not provide the underlying appointment service and is not responsible for a Provider’s professional performance, the quality of services delivered, or the relationship between a Provider and their Client.

6. Provider accounts and responsibilities

  • You are responsible for your account’s security and for activity conducted through it.
  • You are responsible for setting accurate pricing, deposit amounts, and Cancellation Policy terms.
  • Your configured Cancellation Policy terms must be accurate, clear, fair, lawful, appropriate to your sector, displayed to Clients before payment, and not misleading or punitive.
  • You are responsible for the services you offer; Forteel is not a party to that service agreement.

7. Subscription, free trial and billing

  • Forteel costs £19.99 per month, billed monthly, after a 14-day free trial.
  • A card is required to begin the trial. The first subscription charge occurs when the trial ends, unless you cancel before then.
  • Subscriptions renew automatically each month until cancelled.
  • You may cancel your Subscription at any time; cancellation takes effect at the end of the current paid period, and you retain access until then.
  • Fees already charged are non-refundable except where required by law.
  • If a subscription payment fails, we may suspend access to the Platform until payment is resolved.
  • We may change Subscription pricing with reasonable advance notice; continued use after a price change takes effect, from your next billing date onward, constitutes acceptance of the new price.

The 14-day free trial is a promotional access period offered by Forteel. Any statutory cancellation rights that apply to you separately are not restricted by these Terms.

8. Provider services and client contracts

The contract for the appointment or professional service booked is between the Provider and the Client. Forteel is not a party to that contract and is not responsible for its performance.

9. Bookings and payment processing

  • Clients see the session price, the amount due, and the Cancellation Policy before completing payment.
  • Booking Payments are processed through Stripe. Forteel does not store full card details.
  • Payment services are provided by Stripe and may be subject to Stripe’s own terms and privacy information. Forteel does not control Stripe’s availability or bank processing times.

10. Cancellation terms and refunds

The Platform determines the applicable cancellation status by comparing the cancellation time with the Cancellation Policy displayed before payment. Depending on those terms and the payment status, Forteel may initiate a refund through Stripe or record the relevant amount as non-refundable under the Provider’s Cancellation Policy. Refund arrival times depend on Stripe and the Client’s bank or card issuer.

11. Provider cancellations

If a Provider cancels a Booking, Forteel may initiate a refund of the amount paid through Stripe. Providers must not use provider-initiated cancellation as a means of avoiding obligations or manipulating booking outcomes.

12. Recovery Queue and waitlist outreach

When a suitable Booking is released, Forteel may check for eligible waitlist Clients whose preferences match the released appointment and send them a direct booking link. Forteel does not guarantee that a released appointment will be rebooked.

13. Acceptable use

You must not use Forteel to:

  • provide false or misleading information;
  • create fake bookings, or manipulate payments, refunds or Cancellation Policy outcomes;
  • scrape, reverse engineer, or gain unauthorised automated access to the Platform;
  • introduce malware or test vulnerabilities without authorisation;
  • impersonate another person or entity;
  • infringe intellectual-property rights;
  • upload unlawful or harmful content;
  • use Forteel for prohibited or high-risk services;
  • share login credentials;
  • interfere with other users’ use of the Platform.

We reserve the right to investigate suspected violations and to cooperate with law enforcement where required.

14. Provider content and intellectual property

Forteel’s software, design and branding are owned by DUTYCREST LTD. Providers retain ownership of their own content (service descriptions, branding, etc.) but grant Forteel a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and process that content solely as necessary to operate, support and improve the service. Providers warrant that they have the rights to use their content and that it is accurate and lawful.

15. Third-party services

Forteel relies on third-party providers including Stripe, Supabase, Resend and Vercel to operate the Platform. Their own terms may separately apply to services they provide.

16. Availability and platform changes

We will provide Forteel with reasonable care and skill. However, we do not guarantee that the Platform will always be uninterrupted, error-free or available at all times.

17. Suspension and termination

We may suspend or terminate an account for material breach of these Terms, for fraud or security risk (immediately, where necessary), or for payment failure (after reasonable notice). On suspension or termination, access to the dashboard and public booking page may be restricted; outstanding Bookings and records are handled in accordance with our Privacy Policy. Provisions intended to survive termination (including liability, intellectual property, and governing law) continue to apply.

18. Disclaimers

Forteel is provided with reasonable care and skill, but we do not guarantee uninterrupted, error-free, or fully available service.

19. Liability

To the extent permitted by law:

  • Forteel is not liable for indirect, incidental or consequential loss, or for loss of profit, revenue, goodwill or opportunity.
  • Forteel is not liable for loss arising from a Provider’s own configured settings, a Client’s actions, or the availability or performance of Stripe or other third-party services used to operate the Platform.
  • Forteel’s total liability for direct loss arising from your use of the Platform is limited to the total Subscription fees paid by you in the 12 months before the claim arose.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.

20. Indemnity

You agree to indemnify DutyCrest Ltd against reasonable losses, costs and expenses arising from:

  • your breach of these Terms;
  • your infringement of third-party rights;
  • your unlawful or fraudulent use of the Platform;
  • your misrepresentation of your services or Cancellation Policy;
  • claims brought by Clients relating to the professional services you provide.

This indemnity does not apply to matters caused by Forteel’s own breach of these Terms or by faults in the Platform.

21. Privacy and cookies

Personal data is handled as described in the Forteel Privacy Policy. Cookies and similar technologies are described in the Cookie Policy.

22. Changes to these Terms

We may update these Terms where necessary to reflect legal, operational or service changes. We will provide reasonable notice of material changes where practicable. Changes will not normally affect Bookings entered into before the revised Terms take effect.

23. General legal provisions

These Terms, together with the Privacy Policy and Cookie Policy, form the entire agreement between you and Forteel regarding your use of the Platform. If any provision is found unenforceable, the remaining provisions continue in effect. We may assign these Terms in connection with a business transfer; you may not assign them without our consent. No failure to enforce a provision constitutes a waiver of it.

24. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. For business Providers, the courts of England and Wales have exclusive jurisdiction. Nothing in this clause affects any mandatory consumer rights or jurisdiction rules that may separately apply to Clients who qualify as consumers.
